Council Development Assessment Panel Member Fundamentals

For: Ne and continuing members of Council Development Assessment Panels (CDAP’s) and Planning Officers/Managers who attend CDAP meetings.
Course Overview:
Councils are required (with certain exceptions) to establish a CDAP comprised of independent members, Council Members and/or Council officers. CDAP is a body of people who consider and make decisions on some development applications in their Council. The role of CDAP is to make impartial and transparent development assessment decisions based on the policies in the Development Plan.
This course will provide participants with the crucial information and knowledge to operate effectively as a CDAP member (either current or seeking appointment onto a CDAP). The course is also equally applicable for Regional CDAP Members.
The course will provide participants with an understanding of:
- overview of the planning framework
- role and responsibilities of CDAPs (including members standards and Code of Conduct)
- relationship between Council Staff and CDAPs
- development assessment
- understanding the Development Plan
- non-complying development
- public notification and rights of appeal
- hearing applicants/representors
- determining/advising a decision - reasons for approval/refusal
- Environment, Resources and Development Court

Paul Leadbeter
Paul has 32 years’ experience in private practice and academia in the areas of Environmental Law, Land Use Planning Law and General Public Law.
Commencing practice in 1982 at Stratford & Co he moved from there to become legal officer for the City of Tea Tree Gully joining Norman Waterhouse in 1985 where he remained as a partner until 1995. He then spent four and a half years as Director of the Australian Centre for Environmental Law and Senior Lecturer at the University of Adelaide Law School. He returned to Norman Waterhouse as a partner in 2001 and left the firm at the end of 2009 to resume a career in academia at the Adelaide Law School where he teaches Administrative Law, Environmental Law, Planning Law and Water Resources Law. He also has a role as a Legal Consultant to Hilditch Lawyers.
Paul has, during his legal career provide advice and representation to a significant and wide range of local government clients, private industry and also developed and conducted a range of training and development programs in the Environmental Law area. He spent a two year term ( 2011-2013) as the Presiding Member of the City of Burnside’s Development Assessment Panel.
