Overview

This course targets those interested or involved in more complex purchasing activities such as public tendering, expressions of interest (EOI) processes and joint purchasing arrangements.  The course begins with a revision of the Local Government purchasing framework and legislation.
 
Participants undertaking this course will gain a better understanding of advanced purchasing processes including scoping, identifying demand, planning, preparing, advertising and publishing Requests for Tender (RFT) or EOIs.
 
Participants will also gain an in-depth understanding of various evaluation models and learn important elements of recommendation report development and preparation.  Matters of probity and ethics, codes of conduct, the Independent Commissioner Against Corruption (ICAC) and other contemporary issues are also addressed.

Overview

Part 1 of this full day program is an information session that addresses the following general Contract Law principles:

 

  • Types of contracts;
  • Express terms v's implied terms;
  • Boiler plate clauses;
  • The 10 most common contractual issues.

 
The discussion of general Contract Law principles will focus on and reference clauses from the Local Government Association Procurement template contracts.

Overview

This course is designed to provide participants with an understanding of the key principles that need to be observed when managing contracts. It will also focus on the critical importance of early involvement in the procurement process, to ensure the market approach will deliver the requirement of Council.

Training covers the various elements of a contract, how to go about identifying risks and how to develop a contract management plan. The course also provides an overview on relevant parts of Local Government Act 1999 (SA). Staff managing contracts will gain a better understanding of contract relationship and performance management.

The course also discusses matters of probity and ethics and Independent Commissioner Against Corruption (ICAC) recommendations. A contract manager’s responsibilities regarding proper record keeping are also addressed.

Overview

Councils have collaborated, particularly in the area of procurement, for a long time. The sector's appetite to do so is increasing as more and more council’s seek to take advantage of the benefits that joint procurement delivers. 
 
Joint procurement has many advantages for councils.  It also comes with risks – a lot of which councils will mitigate through partnership agreements (and charters).    
 
The risks associated with breaching competition laws, namely cartel conduct, is not necessarily being successfully addressed through the joint procurement models and in some instances, negotiating behaviours by councils under a joint procurement model can exacerbate these risks.
 
In November 2017, the Competition and Consumer Act 2010 (Cth) was amended to enable joint procurement activities to receive the benefit of the joint venture exception.  The change in law has provided the opportunity for regional subsidiaries and groups of councils to structure their arrangements to fall within the exception, and avoid the risks of cartel conduct for future procurements.
 
This session will discuss the various governance models that are available to Councils who wish to undertake joint procurement.  The purpose of this session is to help councils to identify and manage these competition compliance risks, in particular in light of recent legislative change.
