Overview

Negotiated civil penalties are fast becoming councils’ go-to enforcement tool under the Planning, Development and Infrastructure (PDI) Act.
Why? They’re timely, cost-effective, and have real impact.
Over the past year, the State Planning Commission has extended this power to all councils, making it a key option when responding to breaches.
Drawing on our work with councils already using this tool, we’re sharing practical insights on how to get it right, including the below key learnings:

Key Learnings

  • Understanding in what circumstances to negotiate civil penalties rather than use other enforcement powers.
  • Recommended process for pursuing civil penalties.
  • How to determine the appropriate quantum.
  • How a civil penalty should be documented.
  • Real-life examples of the process.
