Overview
Drowning is the leading cause of accidental death in young children.Most deaths occur in swimming pools that are located on private land, where swimming pool safety fencing or barriers are either not installed or are not compliant with the relevant legislative requirements. Council remains the statutory authority with the task of ensuring that swimming pool safety features are compliant, and when they are not, to take action to ensure any safety risks are addressed. In order to fulfill this role, council officers must understand what the relevant legislative requirements are, and what enforcement action can be taken to ensure compliance.
In this session, we will review the relevant requirements in relation to swimming pools safety features, including the legal obligations of landowners when selling their property, provide an overview of the key practice, legal and risk issues which may arise in the course of council inspections relating to swimming pools, and importantly set out some strategies for councils to consider in ensuring compliance action is effective.

- Review of relevant requirements in relation to swimming pool safety features;
- Review of obligations of a vendor and purchaser when selling a property which contains a swimming pool;
- Review of Practice Direction 8 – Swimming Pool Inspection Policy 2019 and council inspections relating to existing swimming pools generally;
- Review of enforcement tools and action that may be taken by council in relation to breaches of the legislative requirements relating to swimming pool safety features, including a review of the existing draft template enforcement notices and emergency orders available through the LGA; and
- Review of recent ERD Court judgment
