Overview

On 1 January 2025 the Environment, Resources & Development Court Rules were repealed and
replaced by the Uniform Civil Rules (UCR). The UCR now governs all proceedings in the ERD Court in addition to proceedings in the Supreme, District, Magistrates & Youth Courts.

This session will assist councils, relevant authorities and those that support them to understand new terminology, processes & procedures established for proceedings in the ERD Court by Chapter 26 of the Uniform Civil Rules (UCR).

In addition, it will offer a practical update on Court appeal and compliance processes, including those associated with the production of Books of Documents, participation at conferences, the endorsement of compromises, engagement of experts, joinder of parties, and the giving of evidence.

Co-presented with Commissioner Damian Dawson of the ERD Court, the session will include valuable insights from his observations and experience. He will also share his expectations, along with helpful tips and potential pitfalls for those who interact with the Court.

Gavin Leydon, Principal – Planning, Development and Environment – Norman Waterhouse Lawyers
Gavin leads the firm’s Planning, Development and Environment Team and is a specialist in property
development, urban and regional planning, environmental and administrative law. He regularly appears as an advocate in a wide range of ERD Court matters.
